9/17 Stupidocrisy: How Big Pharma got immunity from COVID

Big pharma and healthcare practiced a form of political blackmail in 2005. They warned lawmakers they would not produce vaccines for pandemics or bioterror unless they were guaranteed immunity from lawsuits. The Republican-led Congress caved. The 2005 PREP Act, signed by President George W. Bush, funneled all future pandemic vaccine injury claims into a stingy, opaque program called the Countermeasures Injury Compensation Program (CICP) instead of the established Vaccine Injury Compensation Program. Since December 2020, only 39 recipients have received $3.1 million total for COVID vaccine-related injuries, while nearly $800 million has been paid to those injured by all other vaccines in that timeframe.

The PREP Act was sold as a national security measure in the wake of 9/11 and anthrax fears. The idea was that lawsuits could stall or bankrupt vaccine makers, so the government would protect them in exchange for rapid production of countermeasures. But the law went far beyond that. It gave the Secretary of Health and Human Services (HHS) sole power to declare what was covered, stripped citizens of state-level protections, and made lawsuits nearly impossible except in cases of proven “willful misconduct.” Even then, the burden of proof was nearly unattainable. Injured parties were left with the underfunded CICP, which denies most claims and excludes pain-and-suffering awards.

At the time, critics (hypocrites) like Senator Ted Kennedy and then-Senator Joe Biden warned this was a blank check for drug companies, concentrating power in one office and leaving ordinary Americans unprotected. Yet when the roll call came, the GOP majority Senate passed the law 93–0. Kennedy, then ranking member of the Health, Education, Labor and Pensions Committee, had received about $254,900 in pharmaceutical contributions in the 2005–06 cycle. Biden’s Senate career brought in about $69,100 from the industry. Later, during his 2020 presidential campaign, pharmaceutical donors rewarded him with a staggering $9 million. The prophecy came true. The PREP Act became a boondoggle for Big Pharma, ensuring billions in profits while vaccine-injured Americans were and are denied justice.

On March 10, 2005, President Trump’s HHS Secretary Alex Azar determined that COVID vaccine injury claims would be handled through CIPC under the PREP Act. This is the direct outcome of votes made in 2005, greased by industry lobbying and campaign cash. As Isaiah 10:1 warns, “Woe to those who decree unrighteous decrees, who write misfortune, which they have prescribed.” Those who warned of the danger voted yes and were rewarded handsomely. And for this injustice perpetrated against the American citizenry, Republicans and Democrats alike were complicit with big pharma and healthcare. Democrats, however, took it to a whole new level. Just follow the money. Some well-intended people were deceived bigtime. The lives of many are forever harmed. President Trump is now demanding accountability.
