Lawfare and the Rise of Soft Tyranny in America

Americans are wakening to the war being waged against those who are critical of the left, in particular, the Democratic Party. It’s not one that is currently fought with bullets, although there have been several recent incidents where radicalized actors have gunned political opponents of the left. More common, however, is lawfare: the deliberate weaponization of the legal system to punish, silence, and eliminate political opposition. It’s not theoretical. It’s not accidental. It’s here, and it’s deliberate. We’re watching it unfold in real time. President Trump is taking heat for pardoning convicted tax evaders Todd and Julie Chrisley, for example, but they are indicative of a more sinister pattern of soft tyranny by Democrat judges.

Todd and Julie Chrisley—stars of the once-popular “Chrisley Knows Best”—were convicted in 2022 for tax evasion and bank fraud. Their sentences? 12 and 7 years, respectively. Judge Eleanor Ross, appointed by Barack Obama, presided over the case. Many argue the punishment far exceeded the crime. Their daughter Savannah became an outspoken advocate for their release, arguing her parents were targeted for their vocal support of President Trump. Trump has now announced he intends to pardon them, calling their treatment “unjust and politically motivated.” Their story is not isolated. Steve Bannon, Peter Navarro, Allen Weisselberg, and Trump himself were prosecuted aggressively by judges aligned with and appointed by the political left.

These represent a larger trend of law being twisted into a partisan weapon. Meanwhile, the same legal system turns a blind eye to Hunter Biden’s (and Joe Biden’s) international dealings, Hillary Clinton’s private servers, and other left-aligned operatives caught red-handed. No indictments. No FBI raids. No harsh sentences. This isn’t justice. This is lawfare. This is a government and judicial system using “process as punishment.” You don’t have to be guilty—you just have to be inconvenient. This is exactly what French political philosopher Alexis de Tocqueville foresaw in his 1835 and 1840 volumes of  “Democracy in America.” He warned not of overt tyranny, but a “soft tyranny,” a smothering legalism where bureaucratic power slowly chokes liberty while promising order and fairness.

He wrote, “It covers the surface of society with a network of small complicated rules… until the nation is reduced to nothing better than a flock of timid and industrious animals, of which the government is the shepherd.” That’s the slow creep we’re seeing now. Not jackboots and jail cells—but gag orders, courtroom bias, and selective prosecution. A government that lets its allies walk free and sends its critics to rot in court. A government that targets half the country while shielding the other is not a republic—it’s a regime. Another warning is found in Proverbs 17:15, “He who justifies the wicked, and he who condemns the just, both of them alike are an abomination to the Lord.” This unjust gavel will not stop at public figures. As we are beginning to see, it will find pastors, parents, patriots—anyone who speaks against the machine. Time to stand.
